These Terms of Service (“Terms”) govern access to and use of the Rentsi website and software service (the “Service”) provided by [COMPANY NAME] (“we”, “us”). By creating an account, starting a trial, or using the Service, you agree to these Terms. If you use the Service for a company, you confirm you are authorized to bind that company (“Customer”).
1. The Service
The Service is cloud software for managing rental properties, including tenant, owner, vendor and maintenance applications, automations, communications tools and reporting.
Paid subscriptions are also governed by the Subscription Agreement. If the two conflict, the Subscription Agreement controls for paid use.
2. Accounts
You are responsible for your users, their logins and everything done under your account. Keep passwords confidential and tell us promptly about any unauthorized use.
You must provide accurate account information and keep it current.
3. Free trials
Trials last the period shown at signup. We may end or change trials at any time. Trial data may be deleted [30] days after a trial ends unless you subscribe.
4. Your data
You own the data you put into the Service (“Customer Data”). You grant us a limited license to host, process and display it only to provide, secure and support the Service and as described in the Privacy Policy.
You are responsible for having the rights and consents needed for the Customer Data you upload, including data about tenants, applicants, owners, vendors and employees.
5. Your legal responsibilities
You remain responsible for your own compliance with laws that apply to your business, including landlord-tenant law, fair housing law, consumer reporting and tenant screening rules (such as the Fair Credit Reporting Act), telephone and text-message consent rules (such as the Telephone Consumer Protection Act), debt collection rules, employee-monitoring notice requirements, data-security and privacy laws, and affordable-housing program requirements.
Features such as letter templates, automations, calculators, checklists and notices are tools. They are not legal, accounting or compliance advice, and you should review anything before you send, serve or file it.
6. Third-party accounts and integrations
Some features work only with accounts you open with other companies, for example a texting/phone provider, an email provider, a payment processor or a bank. Those companies' terms and fees apply between you and them. We are not responsible for their services, outages or charges, or for messages and payments they process.
7. Acceptable use
You must follow the Acceptable Use Policy.
8. Fees
Fees, billing, renewal and cancellation for paid plans are set out in the Subscription Agreement and on the pricing page.
9. Changes
We may update the Service and these Terms. If a change to these Terms is material, we will give notice by email or in the Service at least [30] days before it takes effect, unless a change is required sooner by law.
10. Suspension and termination
We may suspend access if you breach these Terms, fail to pay, or if your use creates a security or legal risk, and we will try to give notice first when reasonable. You may stop using the Service at any time.
11. Disclaimers
Except as expressly stated in a signed agreement, the Service is provided “as is” and “as available”, and we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.
12. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and each party's total liability is limited as set out in the Subscription Agreement (or, for free use, to [US $100]).
13. Governing law
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules. Disputes will be brought in the courts located in [COUNTY, STATE].
